• Statutory ABC Test (California, Massachusetts, New Jersey, Washington, Illinois): Requires that (A) the worker is free from control and direction; (B) the work performed is outside the hiring entity's usual course of business; and (C) the worker is customarily engaged in an established trade.

Tax documentation requirements depend on the governing jurisdiction and cross-border residency:
• United States: IRS Form W-9 (TIN/SSN/EIN certification) for U.S. contractors and Form W-8BEN for foreign contractors, with annual nonemployee compensation reporting.
• Canada: CRA Form T4A (Box 048) for service fees over $500 CAD, Social Insurance Number (SIN) or CRA Business Number (BN), and GST/HST/QST registration where applicable.
• United Kingdom: HMRC Unique Taxpayer Reference (UTR) for Self-Assessment and VAT Registration.

Under copyright law, an independent contractor generally owns the work product they create unless transferred in writing:
• In the United States: The contract must designate the work as a "work made for hire" under 17 U.S.C. § 101, supplemented with an assignment of all copyrights upon payment.
• In Canada, the UK, Australia, and International Jurisdictions: "Work made for hire" applies only to traditional employees. The contract must contain a comprehensive written Intellectual Property Assignment accompanied by an express, irrevocable Moral Rights Waiver (such as under Section 14.1 of the Copyright Act of Canada).
